| 05/25/2001 | Order/Procedural | Filed Order. On January 23, 2001, appellants filed a substitution of attorneys purporting to substitute themselves in proper person for attorney Michael L. Matuska. We disapprove the substitution. We elect to treat the document as a motion to withdraw as counsel of record and we grant the motion. We direct the clerk to remove Mr. Matuska from this court's docket as appellants' counsel of record. Mr. Matuska shall serve a copy of this order on appellants and file proof of service with this court within 10 days from the date of this order. On March 28, 2001, we received a proper person letter from appellants indicating that they are unable to fin new counsel and that they may be requesting a dismissal of this appeal. Appellants shall have 30 days from the date of this order to inform this court in writing whether they wish to continue this appeal. Failure to inform this court whether they wish to continue this appeal may result in the dismissal of this appeal as abandoned. If appellants wish to continue this appeal, they shall have 45 days from the date of this order to either (1)retain new counsel and cause new counsel to file a notice of appearance with this court, or (2) inform this court in writing that they do not intend to retain new counsel. On April 5, 2001, respondent Rock Island Corporation filed a motion to dismiss appeal. On April 22, 2001, respondent Judy Lu Shallenberger filed a joinder in that motion. We deny respondents' motion to dismiss. The settlement judge has filed a report that the parties were unable to agree to a settlement. Nevertheless, the briefing schedule and time deadlines for requesting transcripts and filing the docketing statement shall remain suspended pending the appearance of counsel.
