| 03/21/2000 | Order/Procedural | Filed Order. On February 7, 2000, Elliot filed a supplemental report, attached to which was a copy of the petition to the California Supreme Court. fn1[Elliot shall provide this court with a file-stamped copy of the petition within 15 days of the date of this order.] Elliot has suggested that in place of, or in addition to, any staus reports required by this court, she should provide Nevada bar counsel with a copy of any pleadings filed and orders entered in the California proceedings. We conclude that this suggestion should be implemented. We conclude that the California authorities should be given an opportunity to address this matter, and so order that this matter shall continue to be held in abeyance. Elliot shall provide this court with file-stamped copies of all proeadings and orders in the California proceedings, as well as copies of all correspondence with the California bar authorities. Elliot shall file a status report with this court no later than six months from the date of this order. Elliot shall serve a copy of the status report on bar counsel. En Banc. " . . . we grant the state bar's petition and disbar Elliot in this state." Elliot and the state bar shall comply with the provisions of SCR 115. | 01/26/2001 | Order/Procedural | Filed Order. Order Temporarily Staying Disbarment Pending Consideration of Rehearing Petition. We conclude that the order of disbarment should be temporarily stayed pending consideration of the petition for rehearing. Accordingly, the order of disbarment is hereby stayed pending further order of this court. In particular, Elliot may continue to practice law, and neither Elliot nor the state bar need comply with the notice provisions of SCR 115 at this time. | | 01-01739 |
| 03/28/2001 | Post-Judgment Order | Filed Order/Rehearing Granted. Order Granting Rehearing, Staying Disbarment and Directing Status Report. After review of Elliot's petition for rehearing, we conclude that it should be granted, subject to strict conditions as set for below. Elliot shall have 30 days from the date of this order to obtain counsel and to have counsel file a notice of appearance with this court. Counsel shall have 60 days from the date of appearance to file a status report attaching copies of papers or orders, if any, from the California proceeding. In light of Elliot's failure to comply with our previous orders and the additional resources, we impose a sanction in the amount of $500, payable to the Supreme Court Law Library. Within 30 days of the date of this order, Elliot shall provide proof to the clerk of this court that the sanction has been paid. The order of disbarment shall continue to be stayed pending further order of this court. Failure to comply with the conditions in this order will result in the stay being lifted and the order of disbarment taking effect. fn1[We note that NRAP 40(e) provides that a petition for rehearing will not 'ordinarily' be granted in the absence of a request for an answer. We conclude that under the circumstances of this case, no answer from the state bar is required.] En Banc | | 01-05409 |

| 07/11/2001 | Order/Dispositional Bar | Filed Order Denying Bar Petition. Order Vacating Disbarment and Denying Petition for Reciprocal Discipline. We agree that disbarment is too sever a sanction in this case. We conclude that two of the exceptions set forth in SCR 114 apply, in that Elliot was deprived of due process, and substantially different discipline is warranted in this state. We further conclude that no further discipline is appropriate, in light of the substantial penalties already imposed upon Elliot. " . . . we vacate our January 19, 2001, order, and deny the petition for reciprocal discipline." EN BANC-WM/CY/MS/DA/RR/ML/NB | | 01-11769 |
