On September 25, 2003, appellant's counsel informed this court that appellant would be withdrawing the petition for rehearing. To date, appellant has not filed a notice withdrawing the petition. Appellant shall have 10 days from the date of this order to inform this court whether he will be withdrawing the petition. If appellant will be withdrawing the petition for rehearing, he shall file a notice to that effect within the same time period. Thereafter, appellant moved for an extension of time to file a petition for rehearing. Respondent opposed the motion. On September 25, 2003, appellant submitted a petition for rehearing. On that same date, appellant's counsel informed this court that appellant would be withdrawing the petition for rehearing. Because appellant's counsel represents that appellant wishes to withdraw the petition for rehearing and because appellant has not responded to our October 23, 2003, order, we conclude that appellant does not wish to proceed with the petition for rehearing. Accordingly, we deny appellant's motion for an extension of time to file a petition for rehearing.
