03/28/2001Order/ProceduralFiled Order. To date, appellant has failed to file the transcript request form or a certificate indicating no transcripts are being requested. Appellant shall have 10 days from the date of this order to file and serve the required document. Failure to comply timely with this order may result in the imposition of sanctions against appellant's counsel. On October 25, 2000, court reporter Julietta Forbes filed rough draft transcripts for proceedings conducted on September 18, 2000. We note that this case is not a fast track case subject to NRAP 3C and therefore all transcripts filed in this matter should be certified transcripts. Unless either party objects within 10 days of the date of this order, we waive the requirements of NRAP 9(b) only as to the transcripts already filed with this court. Any additional transcripts filed in this matter pursuant to a transcript request form shall be certified transcripts. 01-05408

05/31/2001Order/ProceduralFiled Order. On February 28, 2001, counsel for appellant, Robert B. Walker, Jr., filed a motion to withdraw as attorney of record in this appeal. No good cause having been shown, we deny Mr. Walker's motion to withdraw. Included in Mr. Walker's February 28, 2001, motion to withdraw, was a request for an extension of time to file the opening brief and Mr. Walker also submitted an opening brief. The brief submitted by Mr. Walker does not comply with the Nevada Rules of Appellate Procedure. We direct the clerk of this court to return, unfiled, the opening brief received on February 28, 2001. Appellant shall have 15 days from the date of this order to file and serve and opening brief and appendix. On March 28, 2001, we entered an order in which we noted that court reporter Julietta Forbes had filed rough draft transcripts for proceedings conducted on September 18, 2000. To date appellant has still failed to comply with NRAP 9(a). Appellant shall have 10 days from the date of this order to file and serve either a transcript request form or a certificate indicating that no transcripts are being requested. fn2[On May 17, 2001, court reporter Forbes filed a certified transcript for proceedings conducted on June 26, 2000.] Failure to comply fully with this order in a timely manner could result in the imposition of sanctions against appellant's counsel. Respondent shall have 45 days from the date of this order to file and serve an answering brief. Thereafter, appellant may file a reply brief, if deemed necessary, within 30 days of service of the answering brief. On May 2, 2001, appellant Warren W. Labrum submitted two proper person motions. Appellant has not requested or been granted leave to file documents in proper person. We further note that appellant is represented by counsel in this appeal. We direct the clerk of this court to return, unfiled, the proper person documents received on May 2, 2001. Appellant shall proceed hereafter by and through counsel. 01-09122

06/05/2001Order/ProceduralFiled Order Denying Motion. On May 31, 2001, this court entered an order that directed appellant to file and serve the transcript request form by June 11, 2001. Because appellant submitted a transcript request form before June 11, 2001, the transcript request form was filed on June 1, 2001. We deny as moot, appellant's motion for an extension of time to file a transcript request form. 01-09367
