07/20/2001Order/CounselFiled Order/Sanctions. We conclude that the actions of the Rawlings firm in this matter fall below the standard of acceptable conduct and, consequently, that the imposition of sanctions is warranted. Accordingly, within 15 days from the date of this order, Rawlings Olsen Cannon Gormely & Desruisseaux shall pay $500 to the Supreme Court Law Library and file with the clerk of this court an affidavit or certificate of payment of sanction. Because the bankruptcy proceeding has concluded, this appeal may proceed. In the interest of judicial economy, we waive the requirement that all documents filed in this court contain an original signature of the attorney of record, and we direct the clerk of this court to file the substitution filed in the district court on June 2, 1999 and attached as Exhibit A to the Rawlings firm's December 13, 2000 status report. The substitution is procedurally defective. Nevertheless, because appellant signed the substitution, it appears that he no longer wishes to utilize the legal services of the Rawlings firm. In the interest of judicial economy, we elect to treat the substitution as a motion to withdraw as counsel of record and, cause appearing, we grant the motion. We direct the clerk of this court to remove the Rawlings firm from this court's docket as counsel of record for appellant. On October 12, 1999, the settlement judge filed a report indicating that the parties have agreed to a settlement. If indeed the parties have reached a settlement of this matter, appellant shall have 30 days from the date of this order to submit to this court a stipulation or motion to dismiss this appeal. Alternatively, if appellant intends to continue this appeal, appellant shall have 60 days from the date of this order to either (1) retain new counsel and cause new counsel to enter a notice of appearance in this court or (2) inform this court in writing that he does not intend to retain new counsel. Finally, in the settlement judge's July 21, 1999, and October 12, 1999 reports, she determined that appellant failed to participate in good faith in the settlement conference process and recommended the imposition of sanctions. No good cause appearing, we decline to impose sanctions against appellant. 01-12398
