03/12/2003Order/ProceduralFiled Order Granting Motion. On March 12, 1999, this appeal was docketed in this court. On March 25, 1999, this court received a notice that respondent filed for bankruptcy. Accordingly, on April 16, 1999, this court ordered this appeal stayed pursuant to 11 U.S.C. ยง 362(a). On December 2, 2002, Claire Fernandez filed a motion requesting that she be substituted in the place of Brent Gramanz as the respondent. Attached to the motion is a 'Settlement Agreement' filed in the United States Bankruptcy Court and an 'Assignment of Interest of Brent Gramanz in T-Shirts and Souvenirs, a Nevada Corporation.' These two documents support Ms. Fernandez's representation that she is responsible for responding to this appeal. The parties have not opposed the motion. We grant the motion. The clerk of this court shall substitute 'Claire Fernandez' in the place of 'Brent Gramanz' as respondent in this appeal. Because Ms. Fernandez is now the respondent and because Mr. Gramanz's bankruptcy has been dismissed, fn1[We note that the United States Bankruptcy Court for the District of Nevada's order dismissing Mr. Gramanz's bankruptcy petition is also attached to the motion.] we lift the stay ordered in our April 16, 1999, order.
