On May 17, 2001, this court entered an opinion affirming the district court's judgment of conviction imposition a sentence of death. On June 12, 2001, the remittitur was issued. On June 22, 2001, this court entered an order granting appellant's motions to recall the remittitur and to stay issuance of the remittitur pending appellant's application to the United States Supreme Court for a writ of certiorari. That order stayed issuance of the remittitur for sixty days, and noted that if within that time period this court received notice from the clerk of the United States Supreme Court that appellant had filed a petition for a writ of certiorari with that court then the stay would remain in effect until final disposition of those proceedings. As this court had not received such a notice within that time period, the remittitur was issued on September 5, 2001. On September 12, 2001, however, this court received a notice from the clerk of the United States Supreme Court that appellant had filed a petition for a writ of certiorari on August 13, 2001. Accordingly, we hereby recall the remittitur. Additionally, the issuance of the remittitur shall remain stayed until final disposition of the certiorari proceedings before the United States Supreme Court. | | 01-15808
