01/07/2002Order/ProceduralFiled Order. Resolving Motions. On March 5, 2001, appellant filed his opening brief and appendix. On April 4, 2001, respondents filed a motion to strike all or portions of appellant's opening brief and appendix and for an award of attorney fees as an appropriate sanction. On May 3, 2001, appellant filed an opposition to respondents' motion to strike and a counter-motion to supplement the record on appeal. Appellant also requests an award of attorney fees. On May 15, 2001, respondents filed an opposition to appellant's counter-motion. On July 30, 2001, appellant filed a motion requesting leave to file a reply to respondents' opposition and submitted a reply. No good cause appearing, we deny the motion. The clerk of this court shall return, unfiled, the reply received on July 30, 2001. Because it appears that appellant has improperly included documents that were never made part of the record below, we grant respondents' motion to strike in part. Specifically the following documents contained in appellant's appendix shall be stricken and all references to these documents shall be disregarded when taking this matter under consideration: (1) the September 16, 1999, and September 18, 1999, Las Vegas Review Journal Articles entitled 'Esmeralda County official faces recall' and 'Esmeralda County holds special election', found on pages 81-83 and pages 5-6, respectively; (2) appellant's and counsel for appellant's affidavits, found on pages 25-28; (3) letter and proposed order dismissing appellant's petition by opposing counsel, found on pages 30-32; (4) Harry Kuehn's (redacted) letter of June 21, 2000, indicating resignation, found on pages 79-80; and (5) the American National Election Study, 1996, found on pages 93-98. In light of our decision to strike the aforementioned documents, we deny appellant's motion to supplement the record with these documents. We decline to strike the October 6, 1999, transcript or other documents made part of the record in Case Number 4875, at this time, and we grant appellant's motion to supplement the record with these documents. Nevertheless, if, upon review of the briefs and appendices filed with this court, we determine that those documents, or any other documents, are improperly presented before this court, we will disregard them and all references to them when taking this appeal under consideration.We are not convinced that the imposition of sanctions against either party is warranted at this time. Accordingly, we deny appellant's and respondents' motions for attorney fees. On April 4, 2001, respondents filed a motion for an extension of time to file the answering brief. Cause appearing, we grant the motion. Respondents shall file and serve the answering brief within 30 days from the date of this order. On July 9, 2001, appellant filed a motion for leave to file a 33-page opening brief. Because the clerk already filed the opening brief on March 5, 2001, we deny the motion as moot. 02-00383
