09/25/1998Order/ProceduralFiled Case Processing Order. This is a motion for an order staying enforcement of a judgment against appellants Sparks Constable John Langon ($100,000) and Reno Constable Ward Peterson ($43,000) pending appeal, without requiring them to post security. The district court granted the constables a stay, to take effect upon the filing of a $143,000 supersedeas bond. Respondent does not oppose a stay, provided that it is conditioned on the posting of adequate security as the district court required in its order granting the stay. fn1[We deny the appellants' motion for permission to file a reply to the County's response.] We conclude the constables are not entitled to an exemption from the security requirement. Since they have already been granted a stay in the district court, effective upon the posting of security, we deny the motion for a stay.
