This is a proper person petition for rehearing of this court's November 20, 1997, order dismissing appellant's appeal for lack of jurisdiction. On January 20, 1998, appellant submitted the instant proper person petition for rehearing. Appellant has also submitted a proper person motion for stay of the deadline to file a petition for rehearing which we construe as a motion to recall the remittitur. fn1[The clerk of this court shall file appellant's proper person motion for a stay submitted on January 12, 1998, and proper person petition for rehearing submitted on January 20, 1998.] We grant appellant's petition for rehearing, we recall the remittitur, and we reinstate this appeal. Because this is a direct appeal, we remand to the district court to secure counsel for appellant. fn2[Because appellant was not represented by counsel in the proceedings below, this appeal is not subject to the provisions of NRAP 3C.] If appellant is indigent, the district court shall have 30 days to appoint counsel. Otherwise, appellant must retain counsel within 30 days and counsel must enter an appearance in the district court. Within 5 days from the appointment or appearance of counsel, the district court clerk shall: (1) transmit to this court a copy of the district court's order; and (2) serve a copy of this order on appellant's counsel. Thereafter, counsel shall have 10 days to enter an appearance with this court. fn3[All filing deadlines shall commence to run from the date on which counsel is required to enter an appearance in this court.] fn4[Although appellant has not been granted permission to file documents in proper person, we have received and considered appellant's proper person documents. We deny as moot appellant's request for leave to file a proper person pleading, supplement to the petition for rehearing, and motion for a delayed appeal.]
