On March 20, 2002, appellant's counsel, Cal J. Potter, III, filed a motion to withdraw as counsel. We grant the motion. Mr. Potter shall have 10 days from the date of this order to serve a copy of this order on appellant and file proof of such service with this court. fn1[On April 8, 2002, we received a proper person letter from appellant opposing Mr. Potter's motion to withdraw. Appellant states that Mr. Potter agreed to bear the costs associated with this matter and has an obligation to continue his representation of her through the appeal. We note that any claim for breach of contract must be filed in the district court in the first instance. We further note that appellant has not been granted leave to proceed in proper person and will not be permitted to file documents in this matter. 08/26/2002Order/ProceduralFiled Order. On May 13, 2002, this court entered an order granting attorney Cal J. Potter's motion to withdraw as counsel of record for appellant. Further, we directed Mr. Potter to serve a copy of that order upon appellant and to file proof of such service with this court by May 23, 2002. As of the date of this order, Mr. Potter has not filed proof of service with this court. Our May 13, 2002, order also gave appellant 60 days from the date of that order to retain new counsel to enter an appearance with this court or to inform this court that she would not be retaining counsel for this appeal. Because it is not clear if Mr. Potter served appellant with a copy of that order, we vacate that portion of the order. Mr. Potter shall have 10 days from the date of this order to serve a copy of this order and our May 13, 2002, order on appellant and file proof of such service with this court. Appellant shall have 70 days from the date of this order to obtain new counsel to represent her and cause new counsel to file a notice of appearance with this court.
