04/14/2005ORDER (RECORD REMAND) On consideration of the report and recommendation of the Board on Professional Responsibility, and it appearing that the Board may not have considered whether an informal admonition is an appropriate sanction, it is ORDERED that this case is hereby remanded to the Board for reconsideration of an appropriate sanction in this case. See In re Schlemmer, 840 A.2d 657 (D.C. 2004). The Court observes that each of the cases relied upon the Board in its effort to maintain consistency in discipline reflects a factor in aggravation expressly found by the Board to be absent in this case. The court also observes that little or no harm resulted from the failure to maintain records as the entire path of the funds from receipt by respondent to disbursement was traceable and the funds were never in jeopardy.
