10/27/2005 ORDERED that this appeal is hereby dismissed for lack of jurisdiction. In the absence of a Super. Ct. Civ. R. 54 (b) certification, dismissal of a third-party complaint is not an appealable order. See Exton v. Gen'tl Elec. Credit Corpo.,. 291 A.2d 706 (D.C. 1972). Appellant's reliance on Fukwu v. Bell Atlantic, 652 A.2d 1109 (D.C. 1995) is misplaced. That case is distinguished by the fact that judgment was reinstated at the same time that the counterclaim was dismissed; thus, nothing remained pending in the Superior Court and the matter as final for the purposes of appeal. That is not the situation presented here where other parts of the case remain pending below. (RZNWNE)
